What is a trademark?
In Brazil, a trademark is a visually perceptible distinctive sign, and can be divided into three main categories: Product or service, used to distinguish product or service from another; Certification, used to attest the conformity of a product or service with certain standards or technical specifications; or Collective, used to identify products or services from members of a particular entity.
Trademarks can also be classified according to their form: Nominative, composed only by a name; Figurative, composed only by a figure; Mixed, when its composition comprises a name and a typography, color or presentation, or, still, containing a figure; and Three-dimensional when it comprises a specific format.
In Brazil, trademarks are protected by means of first registration, guaranteeing to its holder the exclusive use of that sign in the national territory, referring to a specific list of goods or services.
